Policy: Administration of Agricultural Land Commission and Soil Conservation Act Application Fees
Preamble: The Agricultural Land Commission Act sets the legislative framework for the establishment and administration of the agricultural land preservation program. The ALR takes precedence over, but does not replace other legislation and bylaws that may apply to the land. Local governments are expected to plan in accordance with the provincial policy of preserving agricultural land.
It is the responsibility of the local government under section 21 of the Act, to forward applications to the Commission.
Policy: Section 33(1) of the Agricultural Land Reserve Use, Subdivision and Procedure Regulation specifies that the prescribed application fees are as follows:
(a) for permission under section 20 or 21 of the Act for a use or subdivision of agricultural land to which section 4 does not apply, $600;
(b) for permission under section 29 or 30 of the Act for the exclusion of land from the reserve, $600;
(c) for permission under section 34(6) of the Act for applications filed directly with the commission, $400.
Pursuant to section33(2) of the Agricultural Land Reserve Use, Subdivision and Procedure Regulation specifies that the prescribed portion of the application fee that the Central Coast Regional District will retain for the purposes of section 35(1) of the Act is $300 for an application
(a) for exclusion under section 29 or 30 if the Act, or
(b) for use or subdivision under section 20 or 21 of the Act.
Pursuant to section33(3) of the Agricultural Land Reserve Use, Subdivision and Procedure Regulation specifies that the prescribed times for the purposes of section 35(1)(b) of the Act are at a time that occurs on or before March 31, June 30, September 30 and December 31 of each year.
Section 33(4) of the Agricultural Land Reserve Use, Subdivision and Procedure
Regulation states that the prescribed portion of an application fee that may be remitted by the commission to a local government for the purposes of section 35(5) of the Act is $200.
Policy P-3 as adopted on April 11, 1995 is hereby replaced.
